Terms of Service

1. Introduction

These terms of service ("Terms") govern your use of the Bookabee platform ("Platform"), operated by Upbeat Software Ltd ("we", "us", "our"), a company registered in England and Wales with company number 17140434. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. About the Platform

Bookabee is a software platform that enables children's activity providers ("Providers") to create and manage classes, sessions, and bookings. Parents and guardians ("Customers") can browse Provider listings and book places for their children. Bookabee facilitates the connection between Providers and Customers but is not itself the provider of any activity or class.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account or allow others to access it.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Provider responsibilities

If you use the Platform as a Provider, you agree that:

  • You are solely responsible for the activities and classes you list on the Platform.
  • All information about your classes (descriptions, pricing, schedules, locations) must be accurate and kept up to date.
  • You are responsible for delivering the activities booked through the Platform to a reasonable standard.
  • You must hold appropriate insurance, qualifications, and safeguarding checks as required for your activities.
  • You are responsible for how you use personal data shared with you through bookings, in compliance with applicable data protection laws.
  • You must not use the Platform for any unlawful purpose.

5. Customer responsibilities

If you use the Platform as a Customer, you agree that:

  • You are responsible for providing accurate booking information, including any required details about your child.
  • You understand that Bookabee is a booking platform and is not the provider of any activity. Your contract for the activity itself is with the Provider.
  • You are responsible for ensuring the suitability of any activity you book for your child.

6. Payments

  • Payments for classes are processed securely through Stripe. Bookabee does not store your card details.
  • Prices are set by Providers and displayed at the time of booking.
  • Bookabee may charge a platform fee on transactions, which is deducted before funds are transferred to the Provider.
  • Payment is taken at the time of booking. If payment fails, the booking will not be confirmed.
  • Some classes may be listed as free, in which case no payment is required.

7. Cancellations and refunds

  • Cancellation policies are set by individual Providers. Please review the Provider's terms before booking.
  • Where a Provider allows self-service cancellation, you may cancel your booking through the Platform.
  • Refund eligibility depends on the Provider's policy and the timing of the cancellation.
  • Bookabee is not responsible for issuing refunds — this is managed between you and the Provider.

8. Franchise arrangements

Some Providers on the Platform may operate as part of a franchise. In such cases, a franchisor organisation may have administrative access to the franchisee's account on the Platform. The relationship between franchisor and franchisee is governed by their own agreements and is separate from these Terms.

9. Intellectual property

All content, design, and software comprising the Bookabee platform is owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform. Content you upload (such as logos, class images, and descriptions) remains yours, but you grant us a licence to display it on the Platform as necessary to provide the service.

10. Limitation of liability

  • Bookabee provides the Platform on an "as is" and "as available" basis.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.
  • Bookabee is not liable for any loss or damage arising from the activities, conduct, or content of Providers.
  • Bookabee is not a party to the contract between Providers and Customers for the delivery of activities.
  • To the maximum extent permitted by law, our total liability to you shall not exceed the fees you have paid to us in the 12 months preceding the claim.

11. Termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use of the Platform poses a risk to others. On termination, any outstanding bookings or payment obligations remain in effect.

12. Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by updating the date at the top of this page. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
